WHAT WE USE YOUR PERSONAL DATA FOR (PURPOSE OF PROCESSING)
Users of the Site/Our apps: At times, You may voluntarily supply us with personal information, such as Your email address and postal address [See Examples of Personal Data We Collect From You], for purposes such as corresponding with Us, registering at the Site, subscribing to a certain service (for example, a mailing list or newsletter), or participating in an online survey or poll. In most of these cases We will rely on Your consent (which can be withdrawn at will as explained in the Special Note on Consent below)
Prospective Clients: If You are a prospective client, We will use Your Personal Data (that You may have provided us and/or that We may have obtained from or verified with third parties) to evaluate any applications or requests You send us to use any of Our services [see Automated Decision-Making section below to learn about how We evaluate certain requests by solely automated means]. Since in such cases Your Personal Data is needed by Us to be able to perform a contract to which You are a party OR for Us to be able to take steps at Your request prior to entering into a contract, We will process Your Personal Data in this manner on the basis of Our Contractual Necessity without needing Your consent.
Clients of Our Services: If You are a client of Our services, We also use Your Personal Data in compliance with the Data Protection Laws insofar as this is required to process a money transaction. For example, for authorisation of transactions, We will require Your Persoanl Data to enable us to identify You when You are using Our services. This is both necessary for the performance of a contract but also a legal obligation imposed on Us (in terms of our anti-money laundering and prevention of terrorism, due diligence requirements).
In case of a money remittance it is necessary that We transfer parts of Your Personal Data to the recipient bank. Furthermore, We will store the remitter’s data at least as part of Your transaction history at Novum Bank Limited (again, all this on the basis of contractual necessity). You must ensure that You have obtained all necessary consents for the use of the recipient`s data before the transaction.
We also use Your Personal Data to verify a User’s identity more generally, where We are bound to do so in accordance with the applicable anti-money laundering and prevention of terrorism legislation and/or if we suspect that a crime has actually been committed (e.g. fraud or other fiscal offences). In order to be compliant with legal requirements concerning the prevention of money laundering and fraud, we are obliged to observe certain transfer limits. In case Your transactions exceed these transfer limits and You are located in Germany, we will carry out an identity check through the German post office (PostIdent) to verify Your identity. Concerning all other countries, please send us a certified copy of Your passport for verification.
If You contact our Customer Services department, we may store any written correspondence between You and Us. We use this information to carry out our services (on the basis of contractual necessity). We rely on this same legal ground to use Your Personal Data when sending You bank statements (which in some cases is also a legal obligation imposed on Us).
Moreover, we may also record any telephone calls You have with us for the same purposes; however, in this case we will inform You at the start of the call that we are about to do so, and You will be given every opportunity not to be recorded. This will be done either on the basis of Our legitimate interests OR if we specifically ask for Your consent, on the basis of Your consent.
Should we need to process Your data for a new purpose in the future, which is entirely unrelated to the above, We will inform You of such processing in advance and You may exercise Your applicable rights (as explained below) in relation to such processing.
Finally, do note that without certain Personal Data relating to You, We may not be in the position to provide some or all of the services You expect from Us or even to guarantee the full functionality of Our Site.

SPECIAL NOTE ON CONSENT

Should You exercise Your right to withdraw Your consent at any time (by writing to Us at the physical or email address below), We will determine whether at that stage an alternative legal basis exists for processing Your Personal Data (for example, on the basis of a legal obligation to which we are subject) where we would be legally authorised (or even obliged) to process Your Personal Data without needing Your consent and if so, notify You accordingly.

AUTHORISED DISCLOSURES
Without prejudice to anything contained in this Privacy Policy and in the interest of full transparency, We reserve the right to disclose (and otherwise process) any relevant Personal Data relating to You which We may be processing (including in certain cases relevant IP addresses) to authorised third parties in or outside the EU/EEA if such disclosures are allowed under the Data Protection Laws (whether or not You have provided Your consent) including but not limited to:
- For the purpose of preventing, detecting or suppressing fraud (for example, if You provide false or deceptive information about Yourself or attempt to pose as someone else, We may disclose any information We may have about You in Our possession so as to assist any type of investigation into Your actions);
- in the event of Novum being involved in a merger, sale, restructure, acquisition, joint venture, assignment, transfer;
- to protect and defend Our rights (including the right to property), safety, or those of our affiliates, of Users of Our Site or even Your own;
- to protect against abuse, misuse or unauthorised use of Our Site;
- for any purpose that may be necessary for the performance of any agreement You may have entered into with Us (including the request for provision of services by third parties) or in order to take steps at Your request prior to entering into a contract;
- to comply with any legal obligations such as may arise by way of response to any Court subpoena or order or similar official request for Personal Data; or
- as may otherwise be specifically allowed or required by or under any applicable law (for example, under anti-money laundering legislation).

SHARING OF PERSONAL DATA WITH OTHER CATEGORIES OF RECIPIENTS
Relevant data will also be disclosed or shared as appropriate (and in all cases in line with the Data Protection Laws) to/with members and staff of Novum, to/with other entities within the Novum Group and/or to/with affiliated entities and/or sub-contractors established within the European Union if pertinent to any of the purposes listed in this Privacy Policy (including to/with Our services providers who facilitate the functionality of the Site and/or any service You may require). Personal information will only be shared by Us to provide the services You request from Us or for any other lawful reason (including authorised disclosures not requiring Your consent).
Any such authorised disclosures will be done in accordance with the Data Protection laws (for example all our processors are contractually bound by the requirements in the said Data Protection Laws, including a strict obligation to keep any information they receive confidential and to ensure that their employees/personnel are also bound by similar obligations.) The said service providers (Our processors) are also bound by a number of other obligations (in particular, Article 28 of the GDPR).

RETENTION PERIODS
We will retain Your Personal Data only for as long as is necessary (taking into consideration the purpose for which it was originally obtained). The criteria We use to determine what is ‘necessary’ depends on the particular Personal Data in question and the specific relationship We have with You (including its duration).
Our normal practice is to determine whether there is/are any specific EU and/or Maltese law(s) (for example tax or corporate laws) permitting or even obliging Us to keep certain Personal Data for a certain period of time (in which case We will keep the Personal Data for the maximum period indicated by any such law). For example, any data that can be deemed to be ‘accounting records’ must be kept for ten (10 years.
We would also have to determine whether there are any laws and/or contractual provisions that may be invoked against Us by You and/or third parties and if so, what the prescriptive periods for such actions are (this is usually five (5) years). In the latter case, We will keep any relevant Personal Data that We may need to defend Ourselves against any claim(s), challenge(s) or other such action(s) by You and/or third parties for such time as is necessary.

AUTOMATED DECISION-MAKING
If You are a prospective client trying to obtain a loan with Us, You will be subject to decision making taken solely by automated means, including profiling (at least at the first stage). This will be done as follows: A business rule engine will work in the background checking input on a loan application with established general business rules (not specific to any individual). This IT system uses business rules stored in database tables. As an example, business rules check minimum age and income thresholds required for an application to proceed to the next level. If the system allows a loan application to be completed, that application will be scored using a pre-set credit scoring model. This model uses several criteria essentially drawn from the Bank’s historical credit behaviour. The credit score business rule has a minimum threshold stored. If a prospective client passes ALL business rules, and credit score, he or she can obtain a loan subject to completing other processes required by the Bank, such as identification and verification, for example.
Since such processing solely by automated means is necessary for You to enter into a contract with Us (if for example, Your credit score is acceptable to Us), We will process Your Personal Data in this manner on the basis of Our Contractual Necessity without needing Your consent (as per Article 22 of the GDPR).

- Special circumstances exist in connection with certain children’s rights.
